EB-2 NIW explained in plain language

The National Interest Waiver lets you self-petition without an employer or PERM. Here is what the three Dhanasar prongs really ask.

What it is

EB-2 NIW is an employment-based second-preference immigrant petition (Form I-140) where the normal job-offer and labor-certification requirements are waived because your work is in the national interest. You can file it yourself.

The three prongs (Matter of Dhanasar)

1. Substantial merit and national importance. The proposed endeavor matters beyond your employer or city: research with broad impact, technology with economic or public-health significance, work in a field the government has flagged as critical. 2. Well positioned to advance the endeavor. Your record shows you can actually do it: publications, citations, patents, funding, letters from independent experts, a concrete plan. 3. On balance, waiving the job offer benefits the United States. It would be impractical to require a labor certification, or the urgency and benefit of your work outweigh the protection the PERM process gives US workers.

Timing

Premium processing is available for I-140 NIW (45 business days). Regular processing varies widely by service center; check the Visaline processing-time page for what people filing recently are seeing.

What the community tracks

On Visaline, NIW filers log the I-140 receipt, any RFE, the approval, and, if their priority date is current, the concurrent or later I-485. Comparing RFE rates between service centers is one of the most-viewed charts on the site.
